2. 2. Definitions

2.1. Data subject: any identified or identifiable natural person based on specific personal data, directly or indirectly.

3. Principles of data processing at Chalet Apartment Hotel Ltd.

4. Scope, Purpose, Legal Basis, and Duration of Personal Data Processing

4.2.1. Offering and Confirmation of Guest Nights

Purpose of processing: Recordkeeping of guest bookings for accommodation services, differentiation between them, and necessary communication for bookings. Legal basis of processing: Voluntary consent of the data subject, Section 169 (2) of Act C of 2000 on accounting, and Section 6 (5) of Act XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activities. Processed data: Identification number, name, phone number, email address, booking date, bank card details. Duration of processing:

- Billing data: 5 years.
- Bank card data until the end of the booking period.
- For direct marketing inquiries, as specified in section 4.7 of this notice. Data Transmission: For card payments, the payer's identifier, transaction amount, date, and time are transmitted to OTP Bank. The legal basis for data transmission is the consent of the data subject.

4.2.2. Guest Night Record Keepin

Purpose of processing: Providing accommodation services, guest record keeping, differentiation between guests, service provision, communication, behavior analysis, targeted service, ensuring and fulfilling bookings, payments, accounting obligations, and direct marketing inquiries. Legal basis of processing: Voluntary consent of the data subject, Section 169 (2) of Act C of 2000 on accounting, and Section 6 (5) of Act XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activities. Processed data: Identification number, name, address, email address, phone number, date, time, guest's car license plate, nationality, ID card or passport number, date of birth, service-related data (e.g., arrival, departure dates, consumption, sports habits), payment data (date, time, itemized bill details, amount), voucher/coupon/check/voucher number, data on the health status associated with healthcare services, consent to the processing of special data, data on opening and closing times managed by the card access system, and related date and time data, as well as consent to direct marketing inquiries. Duration of processing:
- For direct marketing inquiries, as specified in section 4.7 of this notice, or until the withdrawal of consent for postal direct marketing.
- For accommodation service usage, 5 years from the last guest night.
- For billing data, 5 years. Data Transmission:
- For determining and collecting tourist tax, the guest's serial number, name, address, date of birth, and the number of nights spent are transmitted to the local municipal tax authority.
- For card payments, the payer's identifier, transaction amount, date, and time are transmitted to ERSTE Bank. The legal basis for data transmission is the Tourist Tax Act of 1990 and the Tax Procedure Act of 2017, and in other cases, the consent of the data subject. In case of consent to direct marketing inquiries, the necessary data (name, email address, date, time) will be recorded in the newsletter database and the postal direct marketing database according to section

Purpose of data processing: Sending email newsletters containing commercial advertisements to interested parties, providing information about current updates. Legal basis of processing: Voluntary consent of the data subject and Section 6 (5) of Act XLVIII of 2008 on the basic conditions and certain limitations of economic advertising activities. Scope of processed data: Identification number, name, email address, IP address, date, time, consent given for direct marketing inquiries. Duration of data processing: 2 years from the user's last activity or data update, 24 hours in the case of unconfirmed subscriptions. 4.4. Prize Draw

Purpose of data processing: Participation in prize draws organized by Chalet Apartment Hotel Ltd., drawing of winners, notification, disclosure, and fulfillment of accounting obligations. Legal basis of processing: Voluntary consent of the data subject. Scope of processed data: Identification number, name, address, email address, date, time, and additional data specific to each draw, which will be provided at the announcement of each respective prize draw. Deadline for data deletion: Data of non-winners will be immediately deleted after the draw, while data regarding winners will be kept for 6 months after disclosure; accounting documents related to prizes will be kept for 8 years in accordance with Section 169 of the Accounting Act. Disclosure: The names of winners, along with the name of their locality and postal code, will be disclosed for 6 months following the draw.

7. Rights of the Data Subject, Remedies

The data subject may request information about the processing of their personal data, request correction of their personal data, and, except for mandatory data processing, request deletion or restriction of data in the manner indicated at the time of data collection or through the contact details provided by the data controller.

7.1 Right to Information

Chalet Apartment Hotel Ltd., as the data controller, takes appropriate measures to provide data subjects with all the information regarding the processing of personal data mentioned in Articles 13 and 14 of the GDPR, as well as all the information according to Articles 15-22 and 34, in a concise, transparent, understandable, and easily accessible form, clearly and comprehensibly formulated.

7.2 Right of Access by the Data Subject

The data subject is entitled to receive feedback from the data controller regarding whether their personal data is being processed, and if such processing is underway, to obtain access to personal data and the following information: the categories of personal data processed, the categories of recipients to whom or to which the personal data have been or will be disclosed, including recipients in third countries or international organizations; the envisaged period for which the personal data will be stored; the right to rectification, erasure, or restriction of processing, and the right to object; the right to lodge a complaint with a supervisory authority; information on the source of data; the existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject. This information is free of charge if the data subject has not previously submitted a request for information on the same data scope to the data controller within the current year. Otherwise, Chalet Apartment Hotel Ltd. may charge a fee, which will be communicated to the data subject before fulfilling the request.

7.3 Right to Rectification

7.5 Right to Restriction of Processing

Upon request of the data subject, Chalet Apartment Hotel Ltd. shall restrict processing if one of the following conditions is met:
- The data subject contests the accuracy of the personal data. In this case, the restriction shall apply for a period enabling the verification of the accuracy of the personal data.

The data subject has the right to object, on grounds relating to their particular situation, at any time to processing of personal data concerning them which is based on public interest or the exercise of official authority vested in the data controller, or on legitimate interests pursued by the data controller or a third party, including profiling based on those provisions.
Upon objection, the data controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defense of legal claims.

7.8 Right to Automated Decision-Making in Individual Cases, Profiling

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

7.9 Right to Withdraw Consent

The data subject has the right to withdraw their consent at any time.

7.10 Right to Judicial Remedies

If the rights of the data subject are violated, they may appeal to the court against the data controller. The court shall proceed with the case out of turn.

7.11  Proceedings before the Data Protection Authority

Chalet Apartment Hotel Ltd. shall indemnify any damage caused to others by the unlawful processing of the data subject's data or by a breach of data security. The data controller shall be exempt from liability if the damage was caused by an unavoidable external circumstance beyond the scope of data processing. Compensation shall not be paid if the damage resulted from the intentional or grossly negligent behavior of the injured party.

8. Other Provisions

Information about data processing not listed in this notice will be provided at the time of data collection.
We inform our customers that the court, public prosecutor, investigative authority, administrative authority, National Authority for Data Protection and Freedom of Information, and other authorized bodies may contact the data controller to provide information, disclose data, transfer data, or make documents available based on legal authorization. Chalet Apartment Hotel Ltd. shall only provide personal data to authorities to the extent necessary to achieve the purpose of the request, provided that the authority has specified the exact purpose and scope of the data.
